ANNAPOLIS – Republicans are pushing to repeal a controversial Maryland regulation that prohibits police from pulling over and looking drivers just because they scent of marijuana, but Democratic leaders say they aren’t eager about dramatic modifications to the state’s cannabis laws this yr.

Senate President Bill Ferguson, D-Baltimore City, says Democrats are solely contemplating what they seek advice from as “enhancements” to Maryland’s cannabis regulation, following its legalization for grownup use final yr.

“I feel we’re going to have a cannabis invoice this yr that type of does some – I don’t wish to name it clean-up – but changes to the system that we handed final yr,” Ferguson mentioned. “I don’t assume you’ll see main modifications to this system, but implementation changes.”

In 2023, the Maryland General Assembly handed the brand new “odor” regulation hoping to forestall unwarranted search and seizure against individuals of shade, in response to members of Maryland’s Legislative Black Caucus, who had been proponents of the invoice. With Democrats controlling each chambers of the General Assembly, their opposition to repeal makes it unlikely.

But critics of the regulation – Republicans specifically – say the regulation is making it more durable for police to do their jobs.

“The irony is, if we see somebody chugging a beer, police can pull them over,” mentioned Sen. William Folden, R-Frederick, a police officer who serves within the legislature.  He says the regulation probably takes away possible trigger for police when “there’s a crime occurring, simply since you’re saying, properly, you’re not allowed to make use of your nostril anymore.”

After voters authorized a poll referendum legalizing cannabis for grownup use, the General Assembly handed laws in 2023 establishing licensing and taxation in addition to different guidelines.

Those legal guidelines had been meant to handle “the harms of the previous with regards to criminalization of cannabis,” Del. Jheanelle Wilkins, D-Montgomery, chairperson of the Black Caucus and sponsor of the odor regulation, informed Capital News Service.

Maryland’s odor regulation isn’t unusual. In truth, a number of states which have legalized cannabis have mentioned its scent doesn’t warrant a police search of a car, or they’re contemplating such a provision.

“The public clearly wished marijuana legalized, tremendous,” mentioned Sen. Jack Bailey, R-Calvert and St. Mary’s. “But we shouldn’t get rid of the necessities.”

But prime Democrats mentioned they’re solely contemplating small alterations, together with changes to the duties and make-up of the Maryland Cannabis Administration and associated authorities.

“It was massively sophisticated, numerous shifting items for the cannabis invoice final yr,” Ferguson mentioned. “And as we’ve been implementing, there’s little issues that need to be labored via.”

Wilkins says the purpose of Democrats and the Black Caucus is “working intently with the administration to guarantee that our intentions of the invoice are carried out.”
